(Mersis: 00998181711900001) (hereinafter referred to as "Zeytu Group") and/or the Zeytu Group Website (www.zeytucp.com, www.zeytu.com.tr), operating under Tunaoglu Holding Limited (UK), you accept all the terms and conditions of this contract. Zeytu Group, the preparers of any content on this site, its employees, and persons or organizations authorized by Zeytu Group, bear no criminal or legal liability for any material or moral damages arising from your failure to read these terms or your failure to comply with them despite having read them.

Any information, statistical figures, and values on the Zeytu Group Website are compiled from sources generally accepted as reliable within common practices; their accuracy and completeness are in no way guaranteed by Zeytu Group. Zeytu Group bears no personal, legal, or criminal liability for any direct or indirect material and/or moral negative and/or positive damages, or other possible damages and expenses, resulting from the use of information, evaluations, comments, and statistical figures and values on the Zeytu Group website.

By accessing this website, you are deemed to have read the warnings and declarations in this contract before receiving services from Zeytu Group, and you accept and undertake that in case of any dispute, claim, or demand regarding this matter, the statements written on this webpage and all other computer records belonging to Zeytu Group shall be presented as the sole and exclusive evidence. This is declared by Zeytu Group and accepted by the person(s)/organization(s) entering this Zeytu Group Website.

1.) Orders and Service Delivery
Your account will be established and your information sent to you after your order passes fraud checks and your payment is received. For payments made by credit card and PayPal, domain names, web hosting, and reseller hosting accounts are set up automatically; however, in case of an issue, setup may take up to 48 hours. For payments made via bank transfer or postal order to our bank or post office accounts, the setup time is a maximum of 2 business days. For VPS (VDS) and dedicated server services, the setup time is 48 hours unless otherwise stated. The delivery time for software and license services is a maximum of 1 week unless otherwise specified in writing/orally. If delivery is not made within the specified time, Zeytu Group is obligated to refund your fee upon your request.

It is your responsibility to provide an active, functional email address during the order process. This email address will be used in case of any irregular behavior or when we need to reach you. It is your responsibility to keep your email address constantly updated and to check it; all emails sent to you are considered delivered. Zeytu Group bears no legal or criminal liability for any damages arising from emails not reaching you or not being read by you.

All information in the form you fill out during the order or registration on our site must be accurate and complete. Zeytu Group reserves the right not to refund or partially refund fees for orders canceled due to incorrect information.

Zeytu Group may request a photocopy/scanned image of your credit card or ID for security purposes when deemed necessary. Failure to provide these may result in your order being canceled and treated as fraudulent, or your service(s) being suspended. Zeytu Group reserves the right not to refund or partially refund fees for accounts suspended due to fraud.

Site Migration
For services where site migration is guaranteed, Zeytu Group makes every effort to migrate your site. However, since site migration is an uncertain process, Zeytu Group does not guarantee that your site will be migrated or how long the migration will take. Each hosting company has a different configuration and/or some hosting companies do not meet the necessary conditions for migration; therefore, it can sometimes be very difficult or impossible to migrate your site correctly/completely/without errors. Your site may be migrated incorrectly and/or not migrated at all. Zeytu Group bears no legal or criminal liability for damages arising from this situation.

2.) Content
All services provided by Zeytu Group are subject to the conditions regulated according to the Constitution of the Republic of Turkey.

You cannot impose any legal liability on Zeytu Group by using the services provided by Zeytu Group; you bear all legal responsibility for every action you take using the services provided to you.

Using our services to violate any copyright or registration rights is prohibited. This includes unauthorized music, books, photos, or other copyrighted materials. Additionally, pornographic/erotic content and content usable for hacking cannot be hosted as per laws. Violation of copyright/registration rights and/or hosting pornographic/erotic content will result in the immediate termination of your service(s). If copyright/registration rights violations and/or hackable content are found, this content will be deleted or access blocked. Repeat offenses may result in service suspension/termination. If you believe such content is hosted using Zeytu Group's services, you can complain by emailing bilgi@zeytu.com.tr. Zeytu Group may request additional information/documents from you regarding your complaint.

Regarding complaints about illegal actions performed using Zeytu Group's services, if Zeytu Group cannot verify the complaint reason or is unsure whether the action constitutes a crime, the service may not be terminated. Zeytu Group does not have the legal authority to make judgments. In such cases, you must legally pursue your rights against the person who performed the action. Zeytu Group bears no legal or criminal liability for any damages arising from such situations.

All services offered by Zeytu Group are only for your use within the permitted limits. If you access any content/file/service for which you are not authorized in any way, it is your responsibility to notify Zeytu Group without using it. Otherwise, you are responsible for covering all material/moral damages you may cause.

Zeytu Group may monitor site content and/or any access for legal reasons, system administration purposes, tracking unauthorized access, verifying security procedures, and/or operational safety. During monitoring, content/information may be tested, recorded, copied, or used for the purposes explained above. Zeytu Group will not use or share your content in any way outside these purposes.

Zeytu Group reserves the right to provide service to or deny service to anyone it wishes. Zeytu Group reserves the right to delete/block access to content deemed contract-violating, provocative, divisive, illegal, or inappropriate from our servers, with or without warning. In such cases, Zeytu Group reserves the right not to refund or partially refund fees.

Illegal content will be reported to authorized units.

Uploading virus-infected content or content like shell scripts that could damage Zeytu Group servers may result in the complete termination of your account without refund. You are obligated to cover all material/moral damages caused to Zeytu Group and/or other users through these means. Securing your account is entirely your responsibility.

For services received from Zeytu Group, you are responsible for ensuring that software/scripts/programs uploaded to your account are secure and that directory permissions are correct. Users are responsible for all actions performed in their accounts. This responsibility includes the username and password. You must use a secure and unpredictable password for your accounts. Furthermore, you are responsible for any malicious software uploaded to our servers using your account. If necessary, Zeytu Group reserves the right to terminate your services without refund or with a partial refund. Zeytu Group will not accept any legal or criminal liability for material/moral damages arising in this regard. You are obligated to cover all material/moral damages caused to Zeytu Group and/or other users using your account.

Zeytu Group reserves the right to request that you modify any website, database, account, or any other material/service.

3.) SPAM Prohibition
Zeytu Group absolutely does not tolerate unsolicited email sending, bulk email sending, or spam emails. Failure to comply will result in your service(s) being terminated with or without notice. Any service causing our IP block to be listed on email blacklists will be terminated without notice.

If our IP block is listed on email blacklists, Zeytu Group reserves the right to request the necessary fee from the person responsible to rectify the situation. This fee is independent of Zeytu Group and will be used to clean the IP block from email blacklists. By receiving service from us, you accept that in such cases, you will pay the required fee without objection within the requested time.

4.) Payment
By receiving services from Zeytu Group, you agree to pay the fee for the service to Zeytu Group. Unless you cancel the service you received, it will continue to renew, and an invoice will be generated. If you do not wish to continue receiving services, you must notify us at least 15 days in advance; your service will be canceled at the end of the day or after the paid period as per your request.

Service cancellation must be done via your customer panel. The cancellation page offers options to cancel the service immediately or upon expiry.

If payment is not made at least 15 days before cancellation, Zeytu Group reserves the right to seek the fee through legal means.

While receiving services from Zeytu Group, you are responsible for ensuring your payment information is up-to-date and paying your invoices on time. If the invoice is not paid on time, Zeytu Group will allow an additional 6 days for payment for web hosting and reseller hosting accounts; after this period, your service will be suspended. 30 days after the due date, your service will be terminated. For domain name, VPS (VDS), and dedicated server services, if payment is not made by the due date, your accounts will be terminated immediately. Zeytu Group cannot be held responsible in any way for material/moral damages or potential data loss arising from this.

Overpayments made mistakenly and/or intentionally will be added to your account as credit and will not be refunded for any reason. You can use this credit for future services from Zeytu Group.

Zeytu Group reserves the right to change product prices at any time without notice.

Zeytu Group will charge you for the cost of resources (disk space, traffic, etc.) used beyond the purchased amount. In such a case, you are responsible for paying the required fee without objection within the requested time. If not paid, your account will be terminated without refund, and Zeytu Group will not be liable for material/moral damages or data loss.

You are responsible for covering all material and moral damages caused to Zeytu Group if fees are withdrawn (dispute, chargeback, etc.) using payment channels without Zeytu Group's knowledge and/or permission.

5.) Backup and Data Loss
While using our services, you are responsible for all your data. Zeytu Group offers the backup service as a convenience and absolutely does not guarantee backups. Zeytu Group cannot be held responsible for any data loss you may experience for any reason.

6.) Service Cancellation and Refund
Zeytu Group reserves the right to terminate any service at any time, with or without notice, without refund or with a partial refund, without stating a reason.

Insulting/displaying rude behavior towards any of our employees will result in the suspension/termination of your account/service(s). In such a case, your membership will be terminated and the contract rescinded without any refund.

By receiving services from Zeytu Group, you undertake to refrain from any comments, behaviors, announcements, posters, writings, words, etc., that damage the commercial reputation of Zeytu Group or its employees. You accept that in case of contrary behavior, you are liable for material and moral compensation, and that Istanbul Courts and Enforcement Offices have jurisdiction in all lawsuits to be filed.

Sites attacking our servers, causing damage directly or indirectly, or causing slowdowns/interruptions may be terminated without notice and without refund. In such cases, Zeytu Group may demand that you cover the damage incurred. In such a case, you are responsible for paying the required fee without objection within the requested time.

For paid services, if the service is canceled before the service period expires (due to contract violation, user request, etc.), the entire service fee or the fee for the unused period will not be refunded. You can use the credit in your account for services you may purchase from us, but no refund or credit will be added for services terminated early.

7a.) Service Usage

7aa.) Web Hosting/Reseller Hosting

Prohibited Actions:
a) Sending bulk emails and SPAM emails for any reason, in any way, is strictly prohibited. Email services are provided solely for your normal correspondence.
b) Resource usage exceeding 25% for longer than 90 seconds is prohibited. Many activities can cause problems, including CGI scripts, FTP, PHP, HTTP, etc. Resource usage reports are detected by Zeytu Group, and Zeytu Group is not obligated to provide any evidence regarding your resource usage.
c) Average daily resource usage exceeding 5% for web hosting accounts and 12% for reseller hosting accounts is prohibited. Many activities can cause problems, including CGI scripts, FTP, PHP, HTTP, etc. Resource usage reports are detected by Zeytu Group, and Zeytu Group is not obligated to provide any evidence regarding your resource usage.
d) Running any server-based program on our servers is prohibited. This includes server-based programs like IRCD.
e) Running spider or indexing programs like Google Cash/AdSpy is prohibited.
f) Running any software that communicates with IRC (Internet Relay Chat) networks is prohibited.
g) Running any proxy application is prohibited.
h) Running any BitTorrent application is prohibited. You may link to legal torrents outside our servers, but you cannot host them on our servers.
i) Running any file sharing/peer-to-peer application is prohibited.
j) Game server applications like Counter-Strike, Half-Life, etc., are prohibited.
k) Running cronjob applications at intervals shorter than 15 minutes is prohibited.
l) Running file sharing software (e.g., Rapidshare, etc.) is prohibited.
m) Running audio stream/video broadcast applications is prohibited.
n) Each web hosting account is limited to a maximum of 250,000 files. Accounts with more than 100,000 files are not backed up by us.

7ab.) VPS (VDS)/Dedicated Server

Prohibited Actions:
a) Sending bulk emails and SPAM emails for any reason, in any way, is strictly prohibited. Email services are provided solely for your normal correspondence.
b) For VPS services, resource usage intense enough to damage other VPS instances is not allowed. This problem is usually caused by intense disk activity.
c) Running any proxy application is prohibited.
d) Running any BitTorrent application is prohibited. You may link to legal torrents outside our servers, but you cannot host them on our servers.
e) Running any file sharing/peer-to-peer application is prohibited.
f) Game server applications like Knight Online, Counter-Strike, Half-Life, etc., are prohibited.

7b.) Backup Limit
Customers who perform backups deemed unnecessary by Zeytu Group continuously may have their service(s) suspended/terminated with or without notice. This clause applies if the backup service is used for purposes other than backup, causing damage to the server.

7c.) Unlimited Web Hosting
a) Unlimited web hosting services cover only the hosting of your website files and the traffic of your website.
b) Unlimited web hosting space cannot be used for data storage and/or backup purposes.

8.) Traffic Usage
You will have a certain traffic limit according to the package you purchased. If this limit is reached/exceeded, the purchased service(s) may be automatically suspended until the next month or until more traffic is purchased. Monitoring traffic usage is your responsibility. Unused traffic cannot be carried over to the next month. Usage beyond your purchased traffic will be billed the following month, and you accept that you will pay this fee without objection within the requested time.

9.) Uptime Guarantee
If the 99% uptime guaranteed by Zeytu Group is not met, Zeytu Group is obligated to provide one month of free usage for the relevant service upon your request. Uptime reports from third-party monitoring software are not valid for Zeytu Group; Zeytu Group maintains and publishes its own uptime reports. To have credit added to your account if the uptime guarantee is not met, you must email bilgi@zeytu.com.tr. For VPS and dedicated server services, the guarantee applies only to the network; Zeytu Group is not responsible for your VPS or dedicated server being operational and/or accessible. In such cases, Zeytu Group will not be aware of the problem unless you notify us. The discount provided for VPS/Dedicated Server services when the uptime guarantee is not met does not cover third-party software/license fees.

The uptime guarantee is not valid during attacks on the server by malicious persons for the purpose of downtime and during previously announced server maintenance. Downtime occurring for these reasons will not be reflected in the uptime percentage.

10a.) Support Scope
You accept that Zeytu Group will not provide support on matters unrelated to the service you purchased. Zeytu Group has no obligation to provide software support or perform user operations (creating mail accounts/configuring mail, creating databases, etc.) for any hosting service purchased. For VPS/dedicated server services, support is provided only for restoring the system to its initial delivered state; additional software installations and user operations are not within the support scope. For software services, Zeytu Group is only obligated to deliver functional software.

To benefit from the support system, you must log in to your customer panel with your password and submit a support ticket via the Support Tickets section. Information related to the account will not be shared, nor will any action be taken, through other channels (email, phone, live support, contact form, etc.).

10b.) 24/7 Support and Support Response Time
The concept of 24/7 support does not mean you will reach us every time you call or receive an immediate response to your support tickets. Our support team tries to respond to your tickets as quickly as possible. 24/7 support indicates that work continues regardless of business hours, and the response time to your support ticket is a maximum of 24 hours in the absence of exceptional circumstances, depending on the workload of the support team.

11.) Reseller Hosting: Customer Responsibility
If you purchase a reseller hosting account, you are responsible for supporting your own customers. Zeytu Group will not provide support to the customers of our reseller hosting users. If any customer of our reseller contacts us, Zeytu Group reserves the right to suspend your account until you deal with your customer. Additionally, our reseller hosting users are themselves responsible for the content of their customers' sites. Zeytu Group cannot be held responsible in any way for illegal actions or contract-violating behavior by the customers of reseller hosting users.

12.) VPS and Dedicated Server
Zeytu Group reserves the right to reset the password of any VPS or dedicated server service it provides. It is the customer's responsibility to maintain a valid email address and root password registered in our system. VPS and dedicated servers are not backed up by us; all data and data backup is the customer's responsibility.

13.) Co-Location (Server Hosting)
Zeytu Group reserves the right to reset the password of any server in its co-location service. It is the customer's responsibility to maintain a valid email address and root password registered in our system. Hosted servers are not backed up by us; all data and data backup is the customer's responsibility.
Zeytu Group reserves the right to retain hosted servers and other equipment as collateral until payment, including legal interest, is made in case of payment delays for co-location services.

14.) Price Change
For the service you purchased, no additional fee will be requested during the purchased service period unless you purchase an additional feature or use beyond the permitted limits. Zeytu Group reserves the right to change prices and renew services at the new pricing upon service expiry.

15a.) Liability for Damages
By receiving services from Zeytu Group, you accept that you will not cause any material/moral damage to Zeytu Group in any way and undertake to cover any material/moral damage caused.

15b.) Legal Obligations
By receiving services from Zeytu Group, you accept not to impose any legal obligation on Zeytu Group. In such a case, you undertake to cover all court and lawyer fees within the requested time. Otherwise, Izmir and/or London Courts have jurisdiction.

16.) Disclaimer
Zeytu Group cannot be held liable for any damage your business may incur. Zeytu Group offers no warranties regarding the services it provides. This includes data loss, delays, interruptions, and incorrect information delivery caused by Zeytu Group or any Zeytu Group official. Zeytu Group will not accept liability if your data/information is obtained by third parties in the event of a hack.

17.) Legal Disclosure
Zeytu Group is obligated to provide any information requested by legal authorities when necessary. This information may include your private information in necessary situations.
